Judge delays Megaupload bail decision

MULTI-MILLIONAIRE Kim Dotcom, accused of being at the centre of an internet "mega conspiracy", will have to wait until at least today to learn whether he is granted bail in New Zealand.
North Shore District Court judge David McNaughton yesterday reserved his decision. He said a written decision would be delivered in the next two days, hopefully today, on whether to grant bail to Mr Dotcom, the burly co-founder of the world's largest file-sharing website, Megaupload.

He and three others face internet piracy charges after being arrested on Friday when police raided Mr Dotcom's $24 million Auckland mansion. The arrests followed an FBI-led investigation into illegal file sharing.

Bail arguments were not heard for the other three: Megaupload's chief marketing officer Finn Batato, 38, co-founder Mathias Ortmann, 40, both from Germany, and Dutch national Bram van der Kolk, 29. The FBI wants to extradite all four to the US.

Prosecutor Anne Toohey said Mr Dotcom was an extreme flight risk, who had been deported previously from Thailand by German authorities.

Mr Dotcom's lawyer, Paul Davison QC, said Mr Dotcom had left Thailand on his own accord after speaking with Thai authorities. He had been in Thailand four days, not long enough to process a deportation bid.

Giggling could be heard when Mr Davison said Mr Dotcom's "distinctive appearance" meant he could not leave the country unnoticed.
